Terms & Conditions

• To apply to Perform Europe, you must meet the following criteria: you are an organisation or individual who:
  • works in the performing arts. Please note that live music performances (including opera or musicals) are not covered by Perform Europe, except for music theatre.
  • is legally based in one of the Creative Europe countries
  • is part of a partnership consisting of at least three partners from different Creative Europe countries and will present at least one artistic work or concept in at least three different Creative Europe countries between 1 July 2024 and 30 November 2025 

• You agree, if selected, to sign a grant agreement at our request and to execute and deliver such grant agreement, and complete any other documentation as may be required for the purpose of giving full effect to the grant agreement.
• You warrant that nothing in your Application Form will infringe the copyright or any other right of any third party; breach any contract, including but not limited to any confidentiality obligations; constitute a contempt of court or expose us to any civil or criminal proceedings; and/or otherwise be intended to bring us or any other party into disrepute. 
• You agree that we may in our sole discretion disqualify you from any step of the Perform Europe process and/or, if applicable, withhold or reclaim any benefit awarded or due to be awarded to you as a result of your participation in the Program if:
  • you supply, or have supplied, any untruthful, incomplete, inaccurate or misleading details and/or information or you have deceived Perform Europe in any way including, without limitation, about your identity;
  • you fail to abide by these Terms and Conditions or the rules and regulations of Perform Europe;
  • you fail to abide by any of our other reasonable instructions or directions;
  • your conduct (including past conduct) brings us or our partners into disrepute;
  • you fail to meet the eligibility requirements (see paragraph 2).
• You agree to notify us of any changes to the circumstances and/or information and/or data provided in your application form, including any criminal charges, investigations and/or convictions which are brought against you, during your continued participation in the Perform Europe selection process and the programme itself.
  
• You agree to indemnify us and our assigns and licensees against any and all claims, losses and/or damages suffered directly or indirectly by us as a result of the breach, non-performance or non-observance by you of any of your obligations and representations under your application form.

• You further agree that any photographic material(s), video material(s) and/or any other materials you have submitted as part of your application form may be featured in the Perform Europe platform and you warrant that you have all the necessary licenses, rights, consents and permissions to authorise us to use your submission in full or in part.
  
• You agree that we have no obligation whatsoever to return any materials which you have submitted as part of your application form and/or in connection with the Perform Europe selection process, whether or not you are selected as a participant, and that we are in no way obligated to use any such materials in connection with Perform Europe.
• You grant us the right to use, in case you are selected, your name, photographs and any material or any contribution in connection with the promotion and exploitation of Perform Europe and/or in connection with us throughout the world in all media in perpetuity.

You shall keep confidential and shall not disclose to any third party any confidential information, photographs or other material relating to us or anyone taking part in it, which comes to your knowledge as result of your participation in the Perform Europe selection process (if any). The foregoing will not include matters already in the public domain (other than by way of your breach of this clause).

• Upon reception of your application, your personal data is collected and further processed for the purpose of the management and administration of experts or procurement or grant procedures by Perform Europe. The collection and process of this data follows our Privacy Policy.
• The information is collected in files stored in an isolated secure system. The information is processed by the Perform Europe team and shared with the Perform Europe Evaluators and Perform Europe Consortium.
• Depending on your selection, the collected personal data and all related information are stored for the duration of Perform Europe. After this time, data will only be stored for archiving purposes in the public interest, and only after you have given your consent.
• In case you wish to verify which personal data is stored on your behalf by Perform Europe, have it modified, corrected, or deleted, or restrict the processing, or object to it or to exercise the right to data portability, please contact info@performeurope.eu and explicitly describe your request. Any correction of your personal data will be taken into consideration from the data protection point of view. Special attention is drawn to the consequences of a request for deletion, as this may lead to an alteration of your application and therefore your selection and/or the grant allowed.

Should there be a dispute regarding your participation in Perform Europe, our decision about such dispute shall be final.
